Terms and Conditions – Homesales.com.au – Welcome to the Family competition.
1. General
- Information on how to enter forms part of these conditions. Entry into the competition constitutes acceptance of these terms and conditions.
- The Promoter is carsales.com Ltd, Level 1, 109 Burwood Road, Hawthorn, Victoria 3166. ABN 91 074 444 018
- For the purposes of these Terms and Conditions, carsales.com Ltd includes all related and subsidiary companies, past, present and future officers, agents, representatives, employees and assigns.
2. Entry Requirements
- Entry is only open to Australian residents who are 18 years or over. Employees of the Promoter and their immediate families and agencies associated with this promotion are ineligible to enter.
- The promotion commences at 4:00am AEST on Wednesday 18th November 2009 and entries close at 4:00am AEST on Wednesday 16th December 2009 (the Promotion Period).
- To enter the draw, participants must visit http://www.homesales.com.au and follow the prompts to participate in the 'Homesales.com.au Welcome to the family competition”. Entrants need to enter all the required fields for the entry to be valid.
- For the purpose of this competition, a unique person is constituted by a unique email address, phone number, first name and last name. For the purpose of clarity, only one entry is permitted per person per calendar month.
- There is a limit of one entry per unique person, per calendar month during the promotional period.
- Entrants may 'refer a friend' to the competition by entering the friends name and email address in the entry form. A referral email will be automatically sent to the friend inviting them to enter the competition. This referral email is subject to the Spam Act 2003. Each friend may only be nominated once during the promotion period and entrants who have already entered the competition cannot be nominated as a friend. If a valid nominated friend enters the competition through the referral email, then the original entrant who nominated them will receive one additional entry into the draw.
3. Prizes
- The first eligible entry drawn at 10am AEST on Wednesday 16th December 2009 will win $5000 worth of their choice of one (1) of the following five (5) vouchers. a) $5000 Freedom furniture voucher b) $5000 Autobarn voucher c) $5000 Peter Stevens voucher d) $5000 Tackleworld voucher e) $5000 cash. The total prize value is worth $5000 and the winner can only choose one (1) voucher and not a mix of the above. All additional costs associated with redeeming the prize are the responsibility of the winner. The winner will be notified in writing using contact details provided in their entry. Their name will be published on http://www.homesales.com.au and published in The Australian on Monday 21st December 2009.
- The prize may not be transferred or substituted except at the Promoters discretion. The Promoters reserve the right to substitute a prize of equal or greater value due to prize unavailability. Any tax on the prize is the responsibility of the winner. Independent financial advice should be sought by any person participating in this promotion.
- The Promoter shall not be liable for any costs associated with the prize before or after the delivery.
- The Promoter shall not be liable for any loss or damage whatsoever that is suffered by any entrant or winner (including but not limited to indirect or consequential loss), or for any personal injury suffered or sustained as a result of taking any prize, except for any liability that cannot be excluded by law. The Promoter shall not be responsible for any entries that are not received or are otherwise interfered with due to problems with the Internet or telecommunications services. No responsibility will be taken by the Promoter for any incomplete, late, lost or misdirected entries.
4. Draw
- The draw will take place at Level 1, 109 Burwood Road, Hawthorn VIC 3122
- The winner will be chosen by a random electronic draw process. The judges' decision is final and no correspondence will be entered into.

- The winners details will be published in The Australian newspaper - date as above.
- The Promoter reserves the right to redraw in the event of any entrant being unable to satisfy these competition conditions, they forfeit or they don't claim the prize. If any prize remains unclaimed or forfeited through ineligibility or otherwise, the Promoter will conduct a further draw or draws, as required, at the same time and place as the original draws but on Monday 18th March 2010. The winner/s of these subsequent draws will be published on http://www.homesales.com.au on Monday 22nd March 2010 and in The Australian newspaper on Monday 22nd March 2010.
5. Entries
- All entries become the property of the Promoter. By entering the promotion, and unless otherwise advised, each entrant also agrees to be entered into a database and the Promoter may use the entrants' names, addresses, telephone numbers and the winners' names and addresses and photographs for future promotional, marketing and publicity purposes in any media worldwide, including sending the entrant electronic messages, without notice and without any fee being paid unless otherwise advised by the entrant.
- The Promoter may require an entrant or prize winner to execute any document necessary to give effect to item 2a).
6. Warranties
- The Promoter does not take any responsibility for any costs associated with entering and/or accessing this competition including and not limited to Internet service provider costs.
- If for any reason this promotion is not capable of running as planned due to any reason, including unauthorised intervention, fraud, or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right (subject to any applicable law) in it's sole discretion to cancel the competition or to disqualify any individual who has tampered with the entry process.
- In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the promotion and recommence it from the start on the same conditions subject to state legislation.
- If the Promoter becomes aware that a prize winner is in breach of any warranty contained in these Terms and Conditions or made subsequently to the Promoter may deem that prize winner ineligible.
- Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a winner or entrant and/or (f) redemption of the prize.
