Terms and Conditions - carsales.com.au & Pat Callinans 4x4 adventures T&C's

1. General

  1. Information on how to enter forms part of these conditions. Entry into the competition constitutes acceptance of these terms and conditions.
  2. The Promoter is carsales.com Ltd, Level 4, 449 Punt Road, Richmond VIC 3121. ABN 91 074 444 018.
  3. For the purposes of these Terms and Conditions, carsales.com Ltd includes all related and subsidiary companies, past, present and future officers, agents, representatives, employees and assigns.
2. Entry Requirements

  1. Entry is only open to Australian residents who are 18 years or over. Employees of the Promoter and their immediate families and agencies associated with this promotion are ineligible to enter.
  2. The Promotion commences at 4:00am AEST on Wednesday 26th October 2011 and entries close at 4:00am AEST on Wednesday 25th April 2012 (the Promotion Period).
  3. To enter the draw, participants must visit http://www.carsales.com.au/competitions and follow the prompts to participate in the “carsales.com.au & Pat Callinan’s 4x4” competition. Entrants need to enter all the required fields for the entry to be valid.
  4. For the purpose of this Promotion, a unique person is constituted by a unique email address, phone number, first name and last name. 
  5. There is a limit of one entry per unique person, per calendar month during the Promotion Period.
  6. Entrants may 'refer a friend' to the competition by entering the friends name and email address in the entry form. A referral email will be automatically sent to the friend inviting them to enter the competition. This referral email is subject to the Spam Act 2003. Each friend may only be nominated once during the promotion period and entrants who have already entered the competition cannot be nominated as a friend. If a valid nominated friend enters the competition through the referral email, then the original entrant who nominated them will receive one additional entry into the draw.
3. Prizes

  1. The first eligible entry drawn at 10am AEST on Wednesday 25th April 2012 will win 1 x Nissan ST Auto Patrol (RRP $65,359), and a Track Trailer TVAN Tanami (RRP - $39,300).  Accompanied by an ARB Gift Voucher to the value of $10,000, a Ray’s Outdoors Camping and Outdoor Gear PRIZE PACK (RRP $8,813.91), and a Pat Callinan’s 4x4 Adventures Pack (including the DVD box sets of Pat Callinan’s 4x4 Adventures Series 2, 3 and 4, a Pat Callinan’s 4x4 Adventures Magazine Subscription for a year and a Mr4x4.com.au sticker) (RRP - $222.60) The prize has a total retail value of $123,695.51. Registration of the car and trailer are included in the prize. All additional insurance, options, petrol, licensing and all other ancillary costs associated with redeeming the prize are the responsibility of the winner. Six (6) runner up prize winners will also be drawn at 10am AEST on Wednesday 25th April 2012 and each will win 1 x Pat Callinan’s 4x4 Adventures Pack (including the DVD box sets of Pat Callinan’s 4x4 Adventures Series 2, 3 and 4, a Pat Callinan’s 4x4 Adventures Magazine Subscription for a year and a Mr4x4.com.au sticker) (RRP - $222.60).  The total prize value of the first place prize and all runner up prizes is $125,031.11. The winners will be notified in writing using contact details provided in their entry. Their names will be published on http://www.carsales.com.au and published in The Australian on Monday 30th April 2012.
  2. The winner must arrange their own collection of the Nissan Patrol from their local dealer and own collection of the Track Trailer TVAN from their local state dealer. The Ray’s Outdoors Camping and Adventure Package is to be picked up by the winner from their local Ray’s Outdoors Store. The Pat Callinan’s 4x4 Adventures Package will be sent out by Pat Callinan’s 4x4 Adventures. The promoter is not liable for any costs associated with the collection of the prize. Any costs will be at the winner's expense
  3. To register the car, the winner must provide the Promoter with the necessary signed documents and identification to satisfy the State Government Body. Once provided the Promoter will transfer registration into the winners name.
  4. The prize may not be transferred or substituted except at the Promoter’s discretion and subject to state legislation. The Promoter reserves the right to substitute a prize of equal or greater value due to prize unavailability. Any tax on the prize is the responsibility of the winner. Independent financial advice should be sought by any person participating in this promotion.
  5. The Promoter shall not be liable for any costs associated with the prize before or after the delivery.
  6. The Promoter shall not be liable for any loss or damage whatsoever that is suffered by any entrant or winner (including but not limited to indirect or consequential loss), or for any personal injury suffered or sustained as a result of taking any prize, except for any liability that cannot be excluded by law. The Promoter shall not be responsible for any entries that are not received or are otherwise interfered with due to problems with the Internet or telecommunications services. No responsibility will be taken by the Promoter for any incomplete, late, lost or misdirected entries.
4. Draw

  1. The draw will take place at Level 3, 449 Punt Road, Cremorne VIC 3121 (new carsales.com Ltd offices as of December 2011).
  2. The winner and subsequent runner up prize winners will be chosen by a random electronic draw process. The judges' decision is final and no correspondence will be entered into.

  2. The winners details will be published in The Australian newspaper - date as above.
  3. The Promoter reserves the right to redraw in the event of any entrant being unable to satisfy these competition conditions, they forfeit or they don't claim the prize. If any prize remains unclaimed or forfeited through ineligibility or otherwise, the Promoter will conduct a further draw or draws, as required, at the same time and place as the original draws but on Wednesday 25th July 2012. The Winners will be notified in writing (via email) as well as in the Australian. The winner/s of these subsequent draws will be published on http://www.carsales.com.au & The Australian Newspaper on Monday 30th July 2012. The winner re-draw will take place at Level 3, 449 Punt Road, Cremorne VIC 3121 at 10:00 am.
5. Entries

  1. All entries become the property of the Promoter. By entering the Promotion, and unless otherwise advised, each entrant also agrees to be entered into a database and the Promoter may use the entrants' names, addresses, telephone numbers and the winners' names and addresses and photographs for future promotional, marketing and publicity purposes in any media worldwide, including sending the entrant electronic messages, without notice and without any fee being paid unless otherwise advised by the entrant.
  2. The Promoter may require an entrant or prize winner to execute any document necessary to give effect to item 2a).
6. Warranties

  1. The Promoter does not take any responsibility for any costs associated with entering and/or accessing this competition including and not limited to Internet service provider costs.
  2. If for any reason this promotion is not capable of running as planned due to any reason, including unauthorised intervention, fraud, or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right (subject to any applicable law) in it's sole discretion to cancel the competition or to disqualify any individual who has tampered with the entry process.
  3. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the promotion and recommence it from the start on the same conditions subject to state legislation.
  4. If the Promoter becomes aware that a prize winner is in breach of any warranty contained in these Terms and Conditions or made subsequently to the Promoter may deem that prize winner ineligible.
  5. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a winner or entrant and/or (f) redemption of the prize.
